The legal basis, cited in full. French Public Health Code, Articles R1334-15 to R1334-29: survey of asbestos-containing materials and products in buildings whose building permit was issued before 1 July 1997 — the date asbestos was banned. A property built after the cutoff cannot be given an asbestos survey. The obligation follows neither from the building's use nor from its condition: it follows from a building permit date, and the module checks it. Having a survey carried out on a building that is not subject to the requirement is not a precaution: it is an unnecessary expense and one more file that buries those genuinely covered by the regulations.

A pre-works asbestos survey is done beforehand, or it is worthless. Dated after the site has opened, it is rejected: the workers have already drilled. That is the very purpose of the arrêté (order) of 16 July 2019.

The required action is calculated, never chosen. For a List A material containing asbestos, the state of conservation dictates the outcome: state 1, periodic assessment within no more than three years; state 2, airborne fiber measurement within three months; state 3, removal or encapsulation work within thirty-six months (art. R1334-27 and R1334-29). An owner does not get to decide that a state 3 will make do with monitoring.

The operator must be certified on the date of the survey, with the specific endorsement for a pre-demolition survey. A report signed outside certification has no validity, and the owner remains solely responsible.

Belgium, the neighboring market. In the Flemish Region, the asbestos certificate (asbestattest) issued by an OVAM-recognized expert has been mandatory for the sale of any building constructed before 2001 since November 23, 2022, and is valid for ten years. Same trade, different law, different threshold: the module supports both regimes, each with its own rules.

The due date comes back on its own. Validating a survey that detected asbestos creates the corresponding periodic inspection in the register: the assessment of the state of conservation comes back every three years.
